Mandatory Legal Standards 6-Hour Course
The NJ Division of Consumer Affairs, requires that all L/CADCs complete a 6-hour continuing education course in Legal Standards pertaining to alcohol and drug counseling in NJ during the initial biennial period pursuant to N.J.A.C. 13:34C-5.2(d). This course provides an overview of changes in laws and regulations including the Uniform Enforcement Act and continuing education. In addition, participants will review regulations related to clinical supervision and telehealth. The course will also address clinical areas of practice such as confidentiality and duty to warn. Participants will review elements of professional conduct including working within the scope of practice, sexual misconduct and harassment as well as self-reporting. This course also focuses on clinical documentation including electronic health records.
Upon completion of this course, participants will be able to:
• Distinguish between statutes and regulations that inform the scope of practice for L/CADCs.
• Discuss the NJ Uniform Enforcement Act
• Outline Duty to Warn, Protect and Report statutes in NJ
• Summarize telehealth regulations in NJ
• Discuss updates in clinical supervision
Presenter: Ana Guerra, LCSW, LPC, LCADC, CCS
Ms. Guerra, is a seasoned mental health professional with extensive experience in mental health and substance use disorders. She specializes in the treatment of Co-Occurring Disorders and Trauma. Ms. Guerra parlayed her clinical experience into a career as an adjunct/faculty member for various colleges and universities in NJ. She proposed, developed the curriculum and taught the Substance Use Disorder courses at Kean University’s Social Work Department. Ms. Guerra teaches across the Bachelor and Master level curriculum in Social Work and Addiction Studies. As a trainer for NJPN, she served as an integral team member revising the CADC curriculum. Ms. Guerra facilitates training and consultation for various mental health, substance use and academic settings. She also maintains a private practice. Ms. Guerra is approved by the Addiction Professionals Certification Board of NJ (APCBNJ) to teach initial and re-certification L/CADC courses. In 2018 & 2019, Ms. Guerra facilitated training for NASW-NJ and the Annual Conference. Ms. Guerra was selected by the Council on Social Work Education (CSWE) to serve on the National Taskforce Committee to develop CSWE’s Substance Use Curricular Guide which was published in 2020. In 2021, Ms. Guerra was approved by the APCBNJ as a Mandatory Legal Class Trainer; then in 2022, the NJ Alcohol & Drug Counselor Committee approved Ms. Guerra to teach the 3-hour Legal Standards course.

This course “Mandatory Initial Legal Standards 6-Hour Course” and the trainer, Ana Guerra have been approved by the Addiction Professionals Certification Board of NJ. This course, provided by Behavioral Health Matters, approval #403101024RECLegal6s has been approved for 6 continuing education credit hours by the APCBNJ. Credentials issued by the APCBNJ, the NJ Board of Marriage and Family Therapy Examiners and the NJ Board of Social Work Examiners recognize such courses. This 6 CE course is approved for social work continuing education hours in accordance with N.J.A.C. 13:44G-6.4c12.

Participants must be present for the duration of event, answer all roll calls and complete a Course Evaluation to be eligible for a Certificate of Completion that will be sent via email within 2 weeks.

CANCELLATION POLICY:
Registration is not complete and space is not reserved until payment is processed and you receive a second confirmation email from BHM. Please provide a reliable/valid email and phone # when registering. If you are unable to attend a training event, you must notify BHM promptly. ALL cancellation notifications must be made via email: contact@behavioralhealthmatters.com; type “Refund Request” in the subject line. The refund request email must be submitted ONE WEEK (7 DAYS) PRIOR TO DATE OF EVENT. After such a date, cancellations, "no-shows", log-in issues, email access issues*, full/partial attendance, etc. will NOT be eligible for a refund. ALL REFUNDS ARE SUBJECT TO A $15.00 (FIFTEEN DOLLAR) PROCESSING FEE. Substitutions are not allowed for virtual courses.
